Fiscal Representation

Fiscal representative in Portugal: what they do and when you can stop

26 October 2026By Mariana Santos

If you live outside Portugal and apply for a NIF, one phrase comes up again and again: fiscal representative. It sounds like a tax adviser or a lawyer. It is neither. A fiscal representative is your official contact point with the Portuguese tax authority, and for many non-residents the law simply requires you to have one. This guide explains what a fiscal representative in Portugal actually does, who needs one, what it should cost, and the exact moment you can stop.

The short answer

A fiscal representative is a person or company resident in Portugal whom you appoint under a power of attorney to be your official contact with Finanças, the Autoridade Tributária. If you live outside the EU and EEA, you must have one to register for a NIF and to meet ongoing tax obligations. Your representative files your application, receives official letters at a Portuguese address and forwards them to you. You can stop once you register your own Portuguese tax address, activate electronic notifications where you are eligible, or become resident.

  • Required for non-residents who live outside the EU and EEA. EU and EEA residents generally do not need one.
  • With our service, 6 months of representation are included in every plan. Fiscal representative renewal after the included 6 months is €99 per year, cancel anytime.
  • Your representative is never responsible for paying your taxes. That duty stays with you.

What a fiscal representative actually is

Start with the legal shape of the role. A fiscal representative, representante fiscal in Portuguese, is a person or company with a tax address in Portugal who agrees to represent you before the Autoridade Tributária e Aduaneira, usually shortened to Finanças or AT. You appoint them with a signed power of attorney, and Finanças records their Portuguese address as the address it uses for you.

That last point is the heart of the job. Finanças communicates by letter and by deadline. Assessments, payment notices, requests for documents and fines all travel to the address on file, and the clock on each one starts whether or not the letter physically reaches you abroad. The representative exists so that there is always a reliable address inside Portugal where those letters land, and a person whose job is to pass them to you fast.

If you are following the full process from abroad, our companion guide on how to get a Portuguese NIF from outside Portugal shows where representation fits into the application itself.

Who legally needs a fiscal representative

The rule depends on where you live, not on your nationality alone. If your tax residence is outside the European Union and the European Economic Area, Portuguese law requires you to appoint a fiscal representative when you register for a NIF and whenever you have tax obligations in Portugal, for example because you own property, earn Portuguese income or run a Portuguese tax file of any kind. There is no remote workaround: without a representative on file, a non-resident application from outside the EU and EEA cannot be completed.

If you live inside the EU or EEA, the picture is softer. You can usually register with your home address, and representation is optional rather than required. Since 1 July 2022 there is a further option: taxpayers who activate electronic notifications on the Portal das Finanças, the tax authority online portal, can in many cases rely on those notifications instead of appointing a representative. Many EU and EEA clients still choose representation for the included period, simply so that a paper letter can never be missed while they settle in.

One more group is often confused by the rule: people who already live in Portugal. If Portugal is your home, you register your own Portuguese address as your tax address and you do not need a representative at all. Representation is a bridge for people whose life is still based abroad.

What your representative does day to day

The daily work is practical, not glamorous, and it is worth knowing exactly what you are paying for. With our service, the representative has four defined duties, which are set out in the fiscal representation section of our home page:

1

Files your NIF application

Your representative files the application with Finanças under your power of attorney.

2

Receives official letters

Finanças letters about you arrive at the representative Portuguese address.

3

Forwards within 1 business day

Every letter is scanned and forwarded to you within 1 business day, with any deadline flagged.

4

Forwards your password

If you chose the password add-on, your posted Finanças password is received and forwarded securely.

The four duties of a fiscal representative with our service.

Beyond those four, a good representative keeps a clear record of what arrived and when, and reminds you before a renewal is due. Speed matters most: a letter left unopened for two weeks can quietly eat most of a response deadline.

What a fiscal representative is not

Just as important is what the role does not include. Your representative is not responsible for paying your taxes, filing your personal tax return or guaranteeing that you meet your obligations. Those duties stay with you, always. If a forwarded letter says a payment is due, the payment is yours to make.

A representative is also not a lawyer and not a general agent. The power of attorney you sign is narrow: it covers your NIF application and fiscal representation, nothing wider. Your representative cannot sell your property, open accounts in your name or make decisions for you, and you should be wary of any arrangement that asks you to sign powers broader than the job requires.

Representation for the application, and ongoing representation

People often mix up two different things. The first is representation for the NIF application itself: the representative files for you because you are abroad, and without that filing role the remote route does not exist for non-EU and non-EEA residents. The second is ongoing representation: the representative stays on your Finanças record afterwards, receiving letters and keeping your official address in Portugal alive month after month.

The application takes days. Ongoing representation lasts as long as your situation requires it, which is why it is priced as a period of cover with a renewal, rather than as a one off task. When you read any offer, check which of the two you are actually buying, and for how long.

What it costs, in the open

With GetYourNIF.pt the numbers are printed before you apply, in the pricing section, not saved for a sales call. Standard is €99 per applicant and Urgent is €145 per applicant, and both plans include 6 months of fiscal representation. Fiscal representative renewal after the included 6 months is €99 per year, and you can cancel anytime once you no longer need representation. Families applying together get 5% off the NIF fees, and the optional Finanças password add-on is €50 per applicant for those who want portal access of their own.

Whatever service you compare, judge the renewal as carefully as the headline price. A low first price with an unprinted renewal can cost more within a year than a clear price that includes a fair renewal from day one. Ask three questions before you pay anyone: how long is included, what is the renewal per year, and can I cancel without a fee when my situation changes.

When you can stop

Representation ends when your facts change, and there are three recognised routes out. The first is the most common: you move to Portugal, or buy or rent a home there, and register that Portuguese address with Finanças as your tax address. Your letters then come to you directly, and the representative is no longer needed. The second route is electronic: if you are eligible, you activate Portal das Finanças electronic notifications, so official communications arrive through the portal instead of by post to a representative. The third route is becoming tax resident in Portugal and updating your address on your Finanças record as part of that move.

The mechanics are simple, but the order matters. First put the new arrangement in place, then end the representation, and ask for confirmation that Finanças has recorded the change. With our service there is no exit fee: we provide the documents you need and confirm the change, the same promise set out in our frequently asked questions. From the date the change is registered, letters go to your new address or arrive as electronic notifications.

Do not cancel first and sort the replacement later. Letters posted in the gap still count as delivered to the old address in the eyes of a deadline, even if nobody is there to forward them to you.

The risk of having no representative when you need one

If the law requires you to have a representative and you simply do not, two things go wrong. The practical one comes first: official letters about your Portuguese tax affairs have nowhere reliable to go. An assessment, a request for documents or a fine can be issued, delivered in law, and run out of time before you ever hear about it, and penalties and interest do not pause because a letter crossed a border slowly.

The second problem is procedural. Steps that need a clean Finanças record, from a property purchase to a visa file that asks for your tax details, get harder when your record carries an address problem or an old unresolved notice. Keeping representation active while you need it is cheap insurance against both kinds of trouble, and it is exactly why the renewal reminder exists: so cover never lapses by accident.

How to choose a fiscal representative

Most representatives do the same legal job, so choose on how the service behaves. Look for pricing printed in full, including the renewal, before you apply. Look for a stated forwarding speed for letters, in our case within 1 business day, because that promise is the service. Check how your documents and data are handled: encrypted upload, no selling of data, and deletion on request under GDPR are the baseline you should expect. Finally, check the exit: real terms for cancelling, no exit fee, and help with the change at Finanças when the time comes.

If a provider cannot answer those points in writing, keep looking. This person stands between you and every deadline Finanças will ever set you.

Frequently asked questions

If you live outside the EU and EEA and register for a NIF or have tax obligations in Portugal, yes, Finanças requires you to appoint a fiscal representative resident in Portugal. EU and EEA residents are generally not required to have one, and since 1 July 2022 many can use Portal das Finanças electronic notifications instead.

Four things: they file your NIF application with Finanças under your power of attorney, they receive official Finanças letters at their Portuguese address, they scan and forward each letter to you within 1 business day, and if you chose the password add-on, they receive your posted Finanças password and forward it to you securely.

No. Your taxes remain your responsibility. A representative is your official contact point with Finanças and passes letters and deadlines on to you. They are not a lawyer, they cannot pay your taxes for you, and they cannot act beyond the power of attorney you signed.

With our service, fiscal representation is included for 6 months in every NIF plan, Standard at €99 and Urgent at €145 per applicant. Fiscal representative renewal after the included 6 months is €99 per year, and you can cancel anytime once you no longer need representation.

When one of three things changes: you register a Portuguese address as your tax address with Finanças, you activate Portal das Finanças electronic notifications and are eligible to rely on them, or you become resident in Portugal and update your address. Until then, if you live outside the EU and EEA, representation has to stay active.

Once the change is registered with Finanças, letters go to your new tax address or arrive as electronic notifications instead. Cancel only after the new arrangement is in place, because letters sent in the gap still count as delivered and deadlines still run.
